Terms of Service

1. Acceptance of these terms

By creating a ServiceBell account or using the service, you agree to these Terms of Service and our Privacy Policy. If you don't agree, please don't use ServiceBell.

2. Who we are and what ServiceBell is

ServiceBell is operated by Ladybug Landscapes Australia Pty Ltd ("we", "us", "our"). It is a maintenance-reminder tool that helps service businesses track recurring jobs for their clients and sends periodic email reminders. It is provided to you for use in your business.

3. Your account

You must be at least 18 years old and provide accurate information when creating an account. You're responsible for keeping your login credentials secure and for all activity that happens under your account.

4. Subscriptions and billing

ServiceBell offers a free tier (currently up to 3 active clients, with weekly digest emails for up to a year) and paid subscription plans (Solo and Growing) billed monthly in advance via Stripe. Subscriptions renew automatically until cancelled. Plan features and pricing may change with reasonable notice; if a change materially reduces what your plan includes, we'll tell you by email before it takes effect so you can cancel if you'd rather not continue.

5. Cancellation and refunds

You can cancel at any time from Account Settings — there is no minimum term, no notice period, and no cancellation fee. Your paid plan stays active until the end of the billing period you have already paid for, and you will not be charged again after that.

We do not offer pro-rata refunds for the unused part of a billing period, because you keep full access until it ends. This does not affect your rights under the Australian Consumer Law, including where a service is not supplied as described — see section 11.

When your subscription ends, reminder emails stop. That is what you are paying for, so we don't keep sending it once you've stopped. You will not receive weekly digests or any other scheduled email after your paid period ends.

Cancelling does not delete anything. Your clients, jobs, schedules and history are all kept exactly as they were, and you can still sign in and see them. This is so that if you come back you don't have to enter it all again — resubscribe and your weekly reminders resume from the next Monday. If you want your data removed rather than kept, delete your account instead — see section 8.

6. Your responsibility for client data

ServiceBell lets you store information about your own clients — such as their name, address, and contact details — in order to generate reminders for you. You are solely responsible for ensuring you have the right to collect, store, and use this information (for example, because these are your existing customers), and for complying with any privacy or data-protection obligations that apply to your business. You agree to indemnify and hold ServiceBell harmless from any claim arising from your collection or use of client data through the service.

7. Acceptable use

You agree not to:

  • Use ServiceBell for any unlawful purpose, or to send unsolicited or abusive communications;
  • Attempt to gain unauthorised access to ServiceBell's systems or other users' data;
  • Interfere with or disrupt the service, or attempt to reverse-engineer it;
  • Use the free tier to circumvent plan limits through repeated account creation.

8. Your data

You own the client and business data you enter into ServiceBell. You can access and manage it at any time through the app. If you delete your account, we retain your data for a 30-day grace period (see our Privacy Policy) before it is permanently deleted.

9. Intellectual property

ServiceBell, including its software, design, and branding, is owned by us and protected by applicable intellectual property laws. These terms don't grant you any rights to our trademarks or branding beyond what's needed to use the service normally.

10. Termination

You may stop using ServiceBell and delete your account at any time. We may suspend or terminate accounts that breach these terms, misuse the service, or where required by law.

11. Your rights under the Australian Consumer Law, and our liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded, restricted or modified. If you are a consumer under that law, you are entitled to remedies that these terms cannot take away.

Where the Australian Consumer Law applies and permits us to limit our liability, our liability for a failure to comply with a consumer guarantee is limited, at our option, to resupplying the service or paying the cost of having it resupplied.

Subject to the above, ServiceBell is provided on an "as is" basis and we do not warrant that it will be uninterrupted or error-free. Reminder emails are a tool to help you, not a guarantee — you remain responsible for following up with your own clients, and we are not liable for work you did not win or revenue you did not earn. Also subject to the above, our total liability to you for any claim arising from your use of ServiceBell is limited to the amount you paid us in the 12 months before the claim arose.

12. Changes to these terms

We may update these terms from time to time. We'll update the "last updated" date above, and let you know by email if changes are material.

13. Governing law

These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia and any courts that may hear appeals from them.
